It was Yates who suggested that he combine the two scripts, Tesich originally balked at the idea, but finally gave in and this script was formed. Yates also said Tesich had trouble coming up with unusual plot twists because he cares more about character than plot when he writes.

The films original title during shooting was "The Janitor Cant Dance", which is the title that both Peter Yates and Steve Tesich liked, but Twentieth Century Fox forced them to change the title during post production, at first to The Janitor (the U.K. title for the film) and finally to Eyewitness, a title Yates to this day still doesnt like.

Rob Brydon played Dustin Hoffman in a deleted scene, which took place at the 1980 Academy Awards and involved Sellers losing the Oscar for Best Actor (for his performance in Being There) to Hoffman (for his performance in Kramer vs. Kramer), during his acceptance speech Hoffman declared "I refuse to believe that I beat Peter Sellers". Though the Academy Awards scene was deleted, the framing scene of Sellers watching it on TV is still in the picture. It has merely been reedited so whats playing on the TV has been changed to the scene from Being There that he filmed. The look on Sellers face as he watches was originally his expression while rewinding the tape of Hoffman saying "I beat Peter Sellers" and playing it over and over again. Stephen Hopkins says on the DVD commentary that the scene was altered because his dramatic point got lost in the exposition of showing Sellers lose the Oscar.
c.		While filming the scenes at the Theater District parking garage, an arrest was being made on the top floor. The production had to wait until the officers vacated the area before continuing filming, thus the sky is black by the time Zach and Emily reach the Ransomer.

In order to make the dalmatian without spots, "Oddball", completely white, the production team tried putting make-up on the dogs, trying to paint off the spots, putting plain white suits on the dogs, finding another breed of dog, none of this worked so eventually the spots had to be removed digitally, erased in each shot.
